Responsibilities
 
  •  Reports to the Assistant General Counsel - Regulatory.
  • Located in Indianapolis, IN
  • Provides legal advice to clients on moderately complex FERC and NERC electric matters. 
  • Applies knowledge of FERC and NERC electric issues while developing subject matter expertise, business acumen and knowledge of business goals and objectives. 
  • Will typically work in conjunction with and may receive specific direction from more senior attorneys.

 

Key Responsibilities:

  •  Works closely with NIPSCO's MISO Team and the responsible subject matter experts to proactively identify internal/external business and regulatory issues.
  • Resolves legal issues and provides proactive, business-savvy legal advice and counsel.
  • Establishes relationships with MISO, PJM, NERC and applicable regional entities to collaboratively resolve complex operations and compliance issues.
  • Researches and summarizes laws, cases, regulations and standards applicable to FERC and NERC electric matters.
  • Works with outside counsel on select matters.
  • Prepares, reviews and revises legal documents.
  • May negotiate with outside parties on contractual issues and legal disputes.
  • Assists in preparation of training materials for clients on legal issues.

 

Practice Area Specific Responsibilities:

  •  Prosecute cases before FERC and handle necessary appeals.
  • Personally handle all aspects of administrative litigation, including trial preparation, discovery, and hearing.
  • Prepare comments and responsive documents for rulemaking proceedings, or manage outside counsel in preparing same.
  • Prepare filings and keep all stakeholders informed of proceedings.
  • Prepare applications to perform new services or amend existing tariff filings and keep all stakeholders informed of proceeding.
  • Participate in or represent NIPSCO in technical conferences.
  • Prepare, review and revise applications for various filings.
  • Prepare responses for notices of potential or alleged violations and show cause orders.
  • Negotiate in hearings or adversarial proceedings.
  • Advise and counsel clients on regulated agreements and projects.
  • Advise and counsel clients on new regulatory rules and standards; and assist in the implementation of new or modified processes to comply with new rules.
  • Timely advise clients and legal department of status of pending matters, including upcoming deadlines.
  • Negotiate and prepare contracts and agreements.
  • Prepare and prosecute facility siting or development applications.
  • Defend NIPSCO against customer complaints before regulatory commissions.
  • Represent NIPSCO in connection with formal or informal complaint proceedings or investigations.
  • Work collaboratively with support staff including administrative assistant, analysts and legal interns to assure that work is properly prioritized and timely completed.
  • Conduct research for projects.

 

Qualifications:

  •  Juris Doctorate from an accredited Law school.
  • 3 - 5 years relevant experience in utilities/energy field within a reputable law firm or in-house legal department of a mid- to large-sized corporation.
  • Experience in the electric industry, including working with an RTO and FERC or NERC practice is strongly preferred; knowledge of either MISO or PJM and FERC strongly preferred.
  • Ability to balance the legal issues of a project with the goals of the business through the demonstration of strong, pragmatic business acumen and the ability to recognize the business consequences of legal advice.
  • Strong, logical legal mind with the ability to apply abstract concepts of law to make timely, well-reasoned and appropriate decisions to solve problems.
  • Strong negotiation and mediation skills.
  • Strong advocacy skills.
  • Strong legal research and writing skills.
  • Skilled at managing multiple tasks simultaneously and effectively.
  • Ability to function autonomously, yet understands necessity of advising management of work progress and any unusual situations.
  • Ability to work independently and efficiently under time pressures and deadlines in a fast-paced environment.
  • Ability to work with cross-functional teams.
  • Adaptable to changing environments.
  • Exercise sound judgment.
